Where your breach of these Terms causes EMWA to suffer loss or become subject to a claim by a third party, you will be responsible for the reasonable losses, costs and expenses incurred by EMWA as a direct result of that breach, to the extent permitted by law.
Nothing in this clause limits any rights or remedies available to EMWA under applicable law.

Website Information
EMWA makes reasonable efforts to ensure that information published on its website is accurate and up to date. However, information may change and EMWA cannot guarantee that all website content will always be complete, accurate or current.
Information provided through the website, including professional, educational, regulatory or technical content, is provided for general information and educational purposes. It should not be regarded as legal, regulatory, medical or other professional advice.
Where appropriate, users should obtain advice relevant to their particular circumstances.
-
EMWA Membership
Certain areas, services, resources and benefits available through the website may be restricted to current EMWA members.
Membership is subject to EMWA’s applicable membership rules, policies, constitution and/or other governing documents.
Where there is any conflict between these website terms and EMWA’s governing documents in relation to membership, the relevant governing documents will take precedence.
Membership benefits, fees and services may be amended from time to time.
Unless otherwise stated at the time of joining or renewal, membership fees are non-refundable once membership has commenced, except where a refund is required by law or where the member has a statutory right to cancel as set out below.
-
Consumer cancellation rights
If you join EMWA as an individual acting wholly or mainly outside your trade, business, craft or profession and you qualify as a consumer under applicable law, you may have a statutory right to cancel a membership purchased online or otherwise at a distance within 14 days of entering into the contract.
Where you expressly request that EMWA begins providing membership services or benefits during the 14-day cancellation period, your cancellation rights and any amount refundable may be affected in accordance with applicable consumer law.
This cancellation right applies to membership only. It does not apply to bookings for conferences, workshops, webinars or other events, which are governed by the event-specific terms referred to in Clause 8, including in circumstances where applicable consumer law does not provide a right to cancel bookings for services supplied on a specific date or during a specific period.
To exercise a statutory right to cancel, you must inform EMWA clearly of your decision to cancel by contacting info@emwa.org. You may, but do not have to, use the following form:

Where you are provided with login details to access member-only areas of the website, you are responsible for keeping those details secure.
Login credentials are personal to the authorised user and should not be shared with another person unless EMWA expressly permits this.
You should notify EMWA promptly if you believe your account has been accessed without authorisation.
EMWA reserves the right to suspend or withdraw access to member-only resources where an account is being misused or where membership has expired or ended.
-
Member-Only Resources
Documents, publications, educational materials, recordings and other resources made available exclusively to EMWA members are provided for the member’s personal and professional use unless otherwise stated.
Member-only materials must not be reproduced, distributed, published, sold, made publicly available or shared with non-members without prior permission from EMWA or the relevant copyright holder.
Any additional conditions displayed alongside a particular resource will also apply.
-
Conferences, Workshops, Webinars and Other Events
EMWA organises conferences, workshops, webinars, training and other professional and educational activities.
Bookings are subject to additional event-specific terms, which will be made available to you during the registration process and which you accept by completing your booking. These terms cover matters including:
- registration and payment;
- member and non-member rates;
- eligibility requirements;
- cancellations and refunds;
- substitutions or transfers;
- attendance and conduct;
- changes to speakers, workshops or programmes; and
- cancellation, postponement or changes to an event.
Where separate booking conditions are provided for an event, those conditions will apply in addition to these Terms and Conditions.
EMWA reserves the right to make reasonable changes to event programmes, speakers, timings, venues or delivery formats where necessary.
Nothing in any event-specific terms affects statutory rights that cannot lawfully be excluded or restricted.
-
Sponsors, Speakers and Workshop Leaders
Sponsors participating in EMWA conferences and events do so under separate sponsorship terms and conditions, which govern matters including the promotion of their products and services at EMWA events.
Speakers, workshop leaders and other individuals presenting at EMWA events do so in a personal professional capacity. They must not represent themselves as acting or speaking on behalf of their employer or any other organisation in connection with their involvement in EMWA activities, except as expressly agreed with EMWA.
EMWA reserves the right to decline or withdraw any application for membership, event registration, sponsorship or participation as a speaker or workshop leader, including where EMWA reasonably considers that the application, registration or conduct of the individual or organisation concerned is inappropriate, unethical, or inconsistent with EMWA’s purpose or values.
-
Educational Programmes and Credits
Where EMWA provides educational programmes, workshops, certificates, credits or other professional development opportunities, participation may be subject to specific eligibility, attendance and completion requirements.
Participants are responsible for ensuring that any EMWA educational activity, certificate or credit meets the requirements of their employer, professional body or other relevant organisation.
EMWA does not guarantee that participation in an activity will be recognised by any particular employer, professional body or other organisation unless expressly stated.
-
Payments, Cancellations and Refunds
Where payments can be made through the EMWA website, applicable prices and any relevant taxes or charges will be displayed during the booking or purchasing process.
Payment must be made using one of the payment methods offered through the website.
Membership cancellations and refunds are governed by Clause 4 of these Terms and Conditions.
Conferences, workshops, webinars, training courses and other events are subject to the event-specific terms referred to in Clause 8, including any applicable cancellation, transfer and refund conditions.
Nothing in any EMWA cancellation or refund policy affects statutory rights that cannot lawfully be excluded or restricted.

All content on the EMWA website is created and published by or on behalf of EMWA. Users and members are not able to post comments or upload content directly to the website.
Where EMWA invites users, members, speakers, authors or other contributors to submit material for publication or use by EMWA, additional submission or publication conditions will apply.
Individuals submitting material must ensure that they have the necessary rights and permissions to provide that material to EMWA and that its use will not infringe another person’s intellectual property, privacy or other rights.
EMWA reserves the right to review, edit, decline or remove submitted material where appropriate.

Nothing in these Terms and Conditions excludes or limits EMWA’s liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the above, EMWA will not be liable for any indirect or consequential loss or damage arising out of or in connection with the use of the website, membership, member resources, events, educational activities or other services provided by EMWA.
